Terms of Service
Effective: June 19, 2026
These Terms of Service ("Terms") govern your access to and use of 1TapTestimonials ("Service"), operated by 1TapTestimonials ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. Account
You must be at least 16 years old and provide accurate information. You are responsible for safeguarding your password and for all activity under your account.
2. Subscriptions and billing
- Paid plans renew automatically each billing period (monthly or annual) until canceled.
- Fees are charged in advance and are non-refundable except where required by law.
- You may cancel any time from your account; cancellation takes effect at the end of the current period.
- We may change pricing with at least 30 days' notice; changes apply at the next renewal.
- Failed payments may result in plan downgrade to the Free tier and feature limits being enforced.
3. Your content
You retain ownership of all video testimonials, text, images, and other content you or your customers upload ("Customer Content"). You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Customer Content solely to operate the Service for you.
You represent that you have the rights and consents necessary for any Customer Content uploaded, including from the individuals appearing in it.
4. Acceptable use
You agree not to:
- Upload illegal, infringing, defamatory, harassing, or sexually explicit content.
- Attempt to breach security, reverse engineer, or interfere with the Service.
- Use the Service to send spam or violate anti-spam laws (CAN-SPAM, CASL, GDPR, etc.).
- Resell or sublicense the Service without our written permission.
We may suspend or terminate accounts that violate these terms.
5. Intellectual property
The Service, including its software, design, and branding, is owned by us and protected by applicable laws. We grant you a limited, revocable, non-transferable license to use the Service per these Terms.
6. Third-party services
The Service integrates with third parties (e.g., Stripe, Supabase). Your use of those services is governed by their respective terms.
7. Termination
You may cancel at any time. We may suspend or terminate the Service or your account for breach of these Terms or to comply with law. On termination, your access ends and your data is deleted per our Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your Customer Content or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which we are organized, without regard to conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction.
12. Changes
We may update these Terms. Material changes will be announced by email or in-product notice. Continued use after the effective date constitutes acceptance.
